We respect your rights
In accordance with Article 1341 of the Italian Civil Code, you, the Customer, declare that in placing a checkmark next to the statement “I agree to the Terms and Conditions” on the Checkout page that you have read and understand and fully accept the following terms and conditions.
Conditions of sale
These conditions regulate the purchase of products and services on sale online at olevoitalia.com (hereafter called Olevo Italia, or “we”).
The company and website are owned and operated by Albertina Marinelli, sole proprietor, VAT number 10836561000, and registered with the Viterbo Chamber of Commerce as REA VT 150180 (consumer code legislative decree n. 206/2005 pursuant to art. 7 of law 29 July 2003 n. 229).
Olevo Italia and its activities are governed by the following laws and amendments:
• Article 1 of the legislative decree 2 August 2007, n. 146, regarding “Implementation of Directive 2005/29 / EC relating to unfair commercial practices between businesses and consumers in the internal market and amending Directives 84/450 / EEC, 97/7 / EC, 98/27 / EC, 2002/65 / EC, and Regulation (EC) no. 2006/2004 .”
• Article 36-bis of the decree-law 201/2011 converted, with amendments, by Law 22 December 2011, n. 214 regarding “Conversion into law, with amendments, of the decree-law no. 201, containing urgent provisions for growth, equity and the consolidation of public accounts.”
• Articles 5, 7, and 28 of the decree-law 1/2012 converted, with amendments, by Law 24 March 2012, n. 27 regarding “Urgent provisions for competition, infrastructure development and competitiveness.”
• Article 1, of Legislative Decree 21 February 2014, n.21, regarding “Implementation of Directive 2011/83 / EU on consumer rights, amending directives 93/13 / EEC and 1999/44 / EC and repealing directives 85/577 / EEC and 97/7 / EC .”
• Article 1, paragraph 6 of the legislative decree 6 August 2015, n. 130 of implementation of Dir. 2013/11 / EU, regarding “alternative dispute resolution / ADR.”
These provisions apply to both parties – both the consumer (you), and the seller (us) – and to all sales contracts concluded with us through our website. It is your responsibility to read and understand these conditions, because ticking the “I agree to the Terms and Conditions” checkbox on the Checkout page – which is obligatory – is your full agreement to these conditions of sale.
Contract type
Online sales on Italian websites are called distance contracts, and are governed by section II article 50 of the Italian and EU consumer code. Because of this, Olevo Italia does not sell to or make sales contracts with persons under the age of 18.
Customs duties
Products to be delivered to destinations outside Italy may be subject to customs duties or import fees. Olevo Italia charges you only the price of the product and the cost of shipping that product to the destination address. These additional duties and fees are your responsibility. Customs policies vary, so recommend that you contact the local customs office for more information.
Sales process
Buying products on our site is a purchase proposal that is confirmed only upon successful receipt of payment by either Paypal or credit card. When we have confirmed receipt of your payment into our accounts, the proposal becomes a fixed sales contract.
If you wish to change or add to your purchase, you may either a) contact us by email, or b) make a new purchase and sales contract. In some circumstances it may be possible to change or add to your initial contract, but we are not obliged to do so. it depends on the request, the initial order, the destination, and shipping and packaging considerations.
On receipt of your purchase proposal, you will receive an Order Confirmation email accepting your order and providing you details of the order number, your purchases, delivery costs, and the Total Price charged to your Paypal account or credit card. These details constitute the acceptance by us of your proposal and entering into a contract with you to deliver those listed products to you for that total price.
At that point, your order is in processing. Within a reasonable time and with all professional care, we will prepare and package your order and deliver it to the courier. You will then receive a confirmation email containing the courier’s tracking ID, related shipping information, and the projected delivery date. Shipping to anywhere in the EU is generally expected to take from 3 to 7 days from the moment the courier receives the package from us.
The sales process is considered completed when the package has been delivered to the Customer, which is when we have been notified that this has in fact been done by the courier.
Codice fiscale
Italian citizens and persons living in or residents of Italy who have a Codice Fiscale are requested to enter this information in the Codice Fiscale field under the Personal Details section on the Checkout page. This is not a legal obligation, but we – Olevo Italia – are required to have it if we are to provide you any form of printed receipt, invoice, or purchase order in your name if requested to do so by you.
Descriptions and images
The information relating to the company Olevo Italia and its activities, the description of the cultivation process, and the characteristics and quality of the oil itself are described clearly and truthfully on our website. The images are an honest photographic representation of the product that is to be delivered to the customer, and is a visual characterization only that is not expected to be exact in all aspects. The written descriptions take precedence in the event of any misunderstanding.
Errors and liabilities
The information relating to the products and our activities provided on our website is constantly updated, and every effort is made to ensure the accuracy of the information and the sense of it. We describe the company and its product as truthfully and accurately as possible, but we cannot guarantee the absence of errors in description or detail, and are not responsible for any misunderstanding or false expectations on the part of the customer, except where it can be proven that we have been deliberately misleading.
We reserve the right to correct errors, inaccuracies, and omissions if and when we find them, or to update or modify information at any time without prior notice, without prejudice to the customer’s rights under these terms and conditions and the Consumer Code.
Returns policy
Distance contracts include a provision known as “Right of Withdrawal,” allowing the Customer to cancel a contract within 14 days, but this provision does not apply to the category of food and drink goods. All products sold by Olevo Italia fall within this category. We do, however, allow you to return products that have been broken or damaged in transit, or that do not conform in some fundamental way to what you thought you were buying. You must do so within seven days of receipt of the product.
Exceptions to the right of return
As perishable food products, you cannot return goods that have been consumed in any substantial quantity, or that you found not to your liking in taste, smell, appearance, or texture. These are purely subjective assessments.
Returns process
Olevo Italia covers the cost of shipping of returns, but only with our explicit written agreement that we will do so. To exercise your right of return you must first contact us by email with a clear explanation of the reason for doing so, and providing photographic evidence of the defect or damage. If we agree to your complaint and the cause of it, you will receive further documentation from us, and instructions, and will return the product to us, in the original packaging, by the shipping method we assign, for further inspection. If we agree to your complaint, you will be offered the option of either a) taking delivery of a replacement product at our cost, or b) receiving a full refund using the same payment method used to purchase the original products.
Jurisdiction
The sales contract between you the customer and Olevo Italia is being concluded in Italy, and is therefore governed by Italian law. Disputes requiring legal intervention relating to the interpretation, execution, or resolution of these Terms and Conditions will be conducted in either a) the court of the customer’s town of residence if the Customer is an Italian resident, or b) the Court of Viterbo, if the Customer is not an Italian resident.
Changes
Olevo Italia reserves the right to modify the website, its policies, its products and prices, and these Terms and Conditions at any time and for any reason or to comply with new laws or regulations concerning online commerce and the regulation of subject matter.
